Exigen vecinos detener torre de 9 pisos en Cerro del Vigía

  • El reglamento permite solamente 2 niveles en la zona y ya van por el cuarto.-

Mazatlán, Sinaloa. 28 de noviembre 2022.-Vecinos del Cerro del Vigía exigieron por enésima vez la intervención de las autoridades municipales  para detener la construcción de una torre departamental de 9 ni veles que “ha presentado desde su proyecto múltiples irregularidades que fueron pasadas por alto por la anterior Dirección de Planeación y Desarrollo Urbano Sustentable que otorgó la licencia de construcción contraviniendo su propio reglamento”.

Como ha ocurrido con la mayoría de los desarrollos en proceso, la licencia de construcción solamente puede otorgarse en esa zona para 2 niveles, pero el desarrollador ya va en el cuarto con intención de construir 9 niveles para 14 departamentos y 2 albercas, según la promoción en redes sociales, violando el reglamento municipal de Obras Públicas que para este tipo de construcción requiere un lote mínimo de mil metros cuadrados y la superficie es de solo 403.95 metros cuadrados.


Publicamos a continuación la carta íntegra enviada al actual alcalde municipal.

Estimado Alcalde de Mazatlán,

Edgar Augusto González Zataráin

Los abajo firmantes, habitantes del Cerro del Vigía en el Centro Histórico de Mazatlán, constituidos en la Asociación de Colonos del mismo cerro, nos dirigimos respetuosamente a Usted, quien ha manifestado y tomado medidas desde el inicio de su Mandato erradicando la corrupción de todo acto de gobierno, para exponerle lo siguiente:

La Empresa Constructora MR EXPERTOS EN INGENIERÍA Y PLANEACION S.A. DE C.V., conocido comercialmente como “El Encanto”, construye  en la parte alta del cerro DEL VIGÍA,  en la calle de Camino al Observatorio 56, una torre de departamentos con 9 niveles que incluye a decir del constructor, 14 departamentos con terraza privada, Jacussi, dos zonas de estacionamiento, dos albercas y zonas verdes.

Esta construcción ha presentado desde su proyecto, múltiples irregularidades que fueron pasadas por alto por la anterior Dirección de Planeación y Desarrollo Urbano Sustentable, dirigida por el Arquitecto Jorge Estavillo Kelly,  quien otorgó la licencia de construcción contraviniendo su propio reglamento.

Entre otras irregularidades, destacan:

  • La licencia se otorga por un año, para la construcción nueva de “4 hab. Multifamiliar moderna con 2,593.50 mts de construcción y 2 albercas con 25mts”; es decir, un total de 2,118.5 mts cuadrados
  • La altura máxima permitida es de 2 niveles. Ya están terminando la edificación del 4º nivel.
  • El proyecto publicitado que ya se construye, establece que será una torre de 9 niveles que incluye 14 departamentos, 2 albercas, un “roof garden”, dos zonas de estacionamiento y zonas arboladas, todo esto en 403.96 metros que mide el terreno.
  • Se establece en la licencia que se trata de una zona habitacional ubicada en el Centro Histórico, con densidad media baja, apta únicamente para residencias unifamiliares y se requiere un lote mínimo de 1000 (un mil) metros cuadrados.
  • La superficie total del terreno es de solo 403.95 mts cuadrados.
  • Se establece en la licencia que el frente mínimo del terreno debe ser de 20mts.
  • La dimensión del frente que establecen los constructores en la calle que esta descrita como Camino al Observatorio, es de 7.05 metros.
  • En el dictamen de alineamiento, en el plano , se señala la calle como Camino al observatorioe y en realidad es Cerrada del Mirador y la que dicen que no tiene nombre, es la de Camino al Observatorio.
  • El terreno tiene acceso en estas dos calles, uno en la parte baja del cerro que es Camino al Observatorio y otro en la calle de arriba que es Privada del Mirador. Entendemos que para burlar las restricciones de construcción, se va a establecer que esta, de acuerdo al reglamento, tendrá solo dos o tres niveles de altura que se establecerán a partir de la calle de arriba, Cerrada del Mirador pero serán nueve niveles a partir de la calle de abajo, Camino al Observatorio. Nos parece que cambiar y confundir los nombres de las calles, parece intencional, no un error involuntario, sino una estrategia
  • En el dictamen de uso del suelo clasifican la zona como zona habitacional con densidad de población media baja, que con la construcción de multifamiliares complicara los servicios de agua potable y drenaje que fueron diseñados para una densidad de población baja.
  • Se establece que la intensidad máxima de construcción del coeficiente de utilización del suelo ( CUS) seria del 2% y en realidad van a construir el 75% con los 9 niveles .
  • La superficie máxima de desplante de Coeficiente de ocupación del suelo, (COS) deberá ser del 75% (Área ocupada/ Área total del terreno). Esto no se cumple. No están dejando áreas libres .
  • En el dictamen se les autorizan 1 cajón de estacionamiento por departamento y el reglamento de construcción en el art. 120 y 225 menciona que deben de tener 2 cajones de estacionamiento por departamento, lo que sería lo adecuado para evitar dejen estacionados autos en la calle que es muy angosta y que además está en una curva, provocando accidentes y congestionamientos.
  • El dictamen de alineamiento establece que las colindancias con construcciones previas, deben guardar 34 mts de distancia.
  • Esto no se ha cumplido, están trabajando pegados al muro de la construcción aledaña., sin dejar ninguna distancia.
  • Por la misma configuración del cerro, casi la totalidad de las calles son muy angostas con un ancho de rodamiento de 6 m en promedio , y la privada del mirador apenas tiene 6.25 m de rodamiento, si se estaciona un auto solo queda un paso en un sentido (esta calle-privada es un circuito en 2 sentidos y es la única calle que sube y baja del cerro que esta en una curva en los dos frentes de este terreno , lo que es un peligro latente de choque.

Este proyecto lleva ya en construcción 10 meses, durante los cuales, hemos acudido a  la Dirección de Planeación, al Tribunal de lo contencioso , la Dirección de  Ecología , a la Dirección de  Protección Civil, a Jumapam solicitando detener la obra. En tres ocasiones efectivamente se ordenó suspender la   construcción, pero a las pocas horas, o días, reiniciaban los   trabajos.

El proceso ha sido desgastante y doloroso, sin embargo, su llegada a la alcaldía de Mazatlán y su coherencia ética, abre para nosotros la posibilidad y la esperanza de que se revisen las condiciones irregulares en que se erige esta construcción y pueda por fin suspenderse. Están trabajando de lunes a domingo a marchas forzadas de las 6 de la mañana a 7 de la noche. Diario despertamos con los sonidos de taladros y martillos.

Este permiso de construcción otorgado el 28 de diciembre de 2021,tiene vigencia hasta el 28 de diciembre de 2022.

Reafirmamos que no nos oponemos a que se edifiquen en el cerro del Vigía construcciones regulares acordes a la ley y al reglamento de construcción de Mazatlán que no afecten de manera tan violenta nuestra vida y nuestro entorno.

Le pedimos que tome cartas en el asunto y nos ayude a lograrlo.

Lo agradecemos de antemano y le deseamos que por el bien de Mazatlán, logre su objetivo de detener y erradicar la corrupción y la impunidad en nuestro Puerto.
